Today, the Ninth Circuit Court of Appeals affirmed the judgment entered against Plaintiff Joaquim Finato, a former client of Keith A. Fink & Associates, his federal action for legal malpractice, breach of fiduciary duty, and related claims against the firm in an unpublished opinion, Appellate Case No. 18-55044. The Law Offices of Olaf Muller represented Keith A. Fink & Associates and its individual partners on this appeal.
Finato challenged the dismissal of all his claims against his former counsel. He challenged the entry of a $22,500 judgment against him in favor of the firm for the quantum meruit value of fees earned by the firm for its legal services rendered. Finato also challenged the trial court’s denial of his request for FRCP 37 discovery sanctions. Finato further challenged the trial court’s decision to conduct a bench trial on the limited issue of the quantum meruit value of his former counsel’s legal services rendered, despite his demand for a jury trial. The Ninth Circuit affirmed all of the trial court’s rulings, as well as the judgment entered.
